Welcome to Bodia - The AI Platform for everyone, It leds you to create new models and fine-tuning them using uploaded images (hereinafter, "Generations"). By using or accessing Generations, you agree to be bound by these terms of Service ("Terms of Service" or "Agreement") between you and Bodia. This Agreement governs your use of Generations and any related services and is a legal contract between you and Bodia. If you do not agree to these Terms of Service, do not access or use Generations.
Under these Bodia terms (this "Agreement"), Bodia ("we", "us" and/or "our") provides access to Bodia's cloud platform, which includes this website, certain API's, and domain registration services (collectively, the "Services"). By accessing or using the Services, you acknowledge that you have carefully read, understood, and agreed to be bound by this Agreement.
If you are agreeing to this Agreement on behalf of a company, business, or other legal entity, you represent and warrant that you have the authority to bind such entity to this Agreement, and in such case, the term "you" shall refer to such entity. If you do not have such authority, or if you do not agree to the terms of this Agreement, you must not accept this Agreement, and you may not use the Services.
IMPORTANT: PLEASE TAKE THE TIME TO CAREFULLY REVIEW THE FOLLOWING MUTUAL ARBITRATION AGREEMENT, AS IT WILL REQUIRE YOU TO RESOLVE ANY DISPUTES WITH VERCEL ON AN INDIVIDUAL BASIS THROUGH FINAL AND BINDING ARBITRATION, THEREBY WAIVING YOUR RIGHT TO PARTICIPATE IN CLASS ACTIONS. BY ENTERING INTO THIS AGREEMENT, YOU ARE EXPRESSLY ACKNOWLEDGING THAT YOU HAVE READ AND COMPREHENDED ALL OF THE TERMS, AND HAVE CAREFULLY CONSIDERED THE CONSEQUENCES OF THIS IMPORTANT DECISION. IN ADDITION TO PROVISIONS ON INDEMNITY AND ASSUMPTION OF RISK, THIS AGREEMENT ALSO CONTAINS RELEASES AND LIMITATIONS ON LIABILITY, ALL OF WHICH MAY SERVE TO LIMIT YOUR LEGAL RIGHTS AND REMEDIES. IT IS IMPORTANT THAT YOU CAREFULLY REVIEW THESE PROVISIONS AS WELL.
Generations is intended for use by individuals who are 16 years of age or older. If you are under 16 years old, you must obtain the consent of a parent or legal guardian before using Generations.
Subject to your compliance with these Terms of Service, Bodia grants you a non-exclusive, non-transferable, revocable, temporary license to use Generations for the duration of your subscription. This license is solely for your personal or business use and is subject to the limitations and restrictions set forth in these Terms of Service.
Generations allows you to upload images to be used for fine-tuning AI models. You represent and warrant that you have the right to use any images you upload and that the use of such images does not violate any third-party rights, including intellectual property rights. By uploading images to Generations, you grant Bodia a non-exclusive, worldwide, royalty-free, and transferable license to use, modify, and reproduce such images solely for the purpose of providing you with the Generations services.
Bodia will store and retain the images you upload to Generations for the duration of your subscription. After the subscription period ends, Bodia may retain your images for a reasonable amount of time in order to comply with legal obligations or for backup and archival purposes. Bodia will not share or disclose your images to any third parties except as required by law or as necessary to provide you with Generations services.
You agree to use Generations in compliance with all applicable laws and regulations, and in a manner that does not infringe or violate the rights of any third party, including but not limited to intellectual property rights, privacy rights, or any other proprietary rights. You may not use Generations to create or distribute any content that is illegal, defamatory, abusive, harassing, or otherwise objectionable.
Bodia takes reasonable measures to protect the security of your images and personal data. However, you acknowledge and agree that no system or technology can be completely secure, and Bodia cannot guarantee the security of your data. You are responsible for safeguarding your login credentials and any other sensitive information associated with your use of Generations.
All including all software, algorithms, data models, and any other materials or content associated with the service, is the exclusive property of Bodia or its licensors. Bodia grants you no ownership or other interest in Generations, except for the limited license to use the service as provided herein.
These Terms of Service constitute the entire agreement between you and Bodia with respect to your use of Generations and supersede all prior or contemporaneous agreements and understandings, whether written or oral, between you and Bodia. If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
